Packaging dispute between alcobev makers moves to SC

The Supreme Court has asked JK Enterprises, the producer of London Pride whisky, to share with the apex court if they were willing to change their packaging, which is challenged under intellectual property rights litigation from Pernod Ricard India.

A bench comprising Chief Justice of India (CJI) DY Chandrachud and Justices JB Pardiwala and Manoj Misra asked the counsel for JK Enterprises to get instructions in this regard, and adjourned the case for two weeks.

The SC was hearing a plea filed by Pernod Ricard India which owns the Blenders Pride whisky brand. Pernod Ricard India has filed a case against trademark infringement by Indore-based company JK Enterprises, which manufactures beverages under the ‘London Pride’ mark.

The appeal before the apex court was preceded by a Madhya Pradesh High court order which had rejected Pernod Ricard India’s petition to halt the sale of London Pride whisky.
